Seaman sues tugboat operator

SEAMAN John E. Hart has filed a lawsuit in federal court against a tugboat operator for injuries he said he sustained in the vessel almost two years ago.

Hart, who is based on Guam, is demanding a jury trial and seeks monetary damages.

Hart sued Cabras Marine Corporation, Saipan Marine Corporation, and Seabridge Inc.

He said he was employed by the companies when the incident happened. The companies maintain a principal office on Saipan.

Hart, who has a 30-year seaman experience, sued the companies for Jones Act negligence and unseaworthiness.

On March 20, 2017 while aboard MT Mangilao, which was owned by Cabras Marine Corporation, Hart said he was injured when the shaft gear box of the vessel came apart and pieces of the gear box struck him in the groin/abdomen area, his face, and other areas of his body.

According to the lawsuit, as a result of the injuries, Hart has sustained and will continue to sustain permanent and painful injuries of body and mind; will continue to suffer physical pain and mental anguish; has incurred and will continue to incur medical, hospital related expenses; and has lost and may continue to lose wages.

Moreover, his lawsuit stated, Hart, “will be in the future prevented from participating in and enjoying the normal pleasures of life to which plaintiff was formerly accustomed.”

Hart is represented by attorneys Bruce Berline and David Banes.

According to his lawsuit, Hart provided “critical maintenance and other work on the vessels and other vessels owned by [the] defendants.”

“The negligence of defendants, their agents, servants, officers and/or employees resulted in, or at the very least, played the slightest part in bringing about Plaintiff Hart’s injuries including his physical, mental, economic and non-economic damages,” the lawsuit added.
