Jury still deliberating in Rota mayor trial

CHIEF Judge Ramona V. Manglona of the District Court for the NMI  ordered the jurors in the trial of Rota Mayor Efraim Atalig and Evelyn Atalig to return to court today, Wednesday, at 8:15 a.m. to continue their deliberations.

The jurors failed to reach a verdict on Tuesday.

They started their deliberations on Monday afternoon after hearing the closing arguments of the defense and the prosecution.

Mayor Atalig is represented by attorney David Banes while Evelyn Atalig is represented by attorney Steven Pixley.

The prosecutors are Assistant U.S. Attorneys Eric O’Malley and Garth Backe.

The Ataligs were charged with conspiracy, wire fraud, theft from program receiving federal funds, and two counts of false statements.

The case stemmed from the defendants’ government-paid off-island trips.

Last week, following a defense motion for acquittal, Judge Manglona acquitted the Ataligs of theft from program receiving funds.

In her instructions to the jurors, the judge said they will deliberate on whether the defendants knowingly participated in a scheme or plan to defraud, or a scheme or plan for obtaining money or property by means of false or fraudulent pretenses, representations, or promises; and whether the defendants acted with intent to defraud, that is, the intent to deceive and cheat.

The judge said the jurors will also deliberate on the following:

  • Whether on Aug. 8, 2018, Mayor Atalig falsely stated to a special agent of the Federal Bureau of Investigation that the purpose of his June 2018 trip to Guam was to meet with DLA Disposition Services (formerly known as DRMO).
  • Whether on Aug. 10, 2018, Evelyn Atalig falsely stated to a special agent of the FBI that the purpose of the June 2018 trip to Guam was to meet with DLA Disposition Services.
