Lawyer charged with DUI

THE Attorney General’s Office has charged local lawyer David George Banes with driving under the influence, reckless driving, and leaving the scene of the accident.

According to Assistant Attorney General Erin Toolan, Banes on March 9, 2020,  “drove, operated, or was in actual physical control of a vehicle while having a blood alcohol concentration of 0.8% or more, or while under the influence of alcohol or while under the combined influence of alcohol and any drug or drugs to a degree that renders the person incapable of safely driving.”

 Banes was also charged with reckless driving and leaving the scene of the accident.

 Banes “drove a vehicle upon a highway in willful or wanton disregard for the safety of persons or property by failing to obey traffic control devices or failing to keep a proper lookout or by failing to maintain his lane of traffic or a combination of violations,” Toolan further alleged.

 While in operation of his vehicle, Banes was likewise “involved in an accident resulting in injury to a person or personal property and failed to stop at the scene of the accident,” Toolan added.

 Banes  struck a parked vehicle and left the scene, she said.

 The AG’s office did not say why it filed the charges three months after the incident.

 The Superior Court, for its part,  has not scheduled a hearing for the case.

 DUI is punishable by 72 hours’ imprisonment and a fine of $500 and suspension of the privilege to operate a motor vehicle for not less than 30 days nor more than six months.

Reckless driving is punishable by a maximum of $1,000 fine or by imprisonment of not more than six months. The defendant must also attend a course in driver education.

 Leaving the scene of an accident is punishable by up to six months imprisonment and a fine of $500 or both.
