Francisco Basa sentenced to 11 months for violating probation

DISTRICT Court for the NMI Chief Judge Ramona V. Manglona has revoked the supervised release of Francisco Nakatsukasa Basa who used methamphetamine and consumed alcohol while on probation.

Judge Manglona sentenced Basa to 11 months in prison and 18 months of supervised release.

Basa was also ordered to self-surrender at the Department of Corrections in Susupe on June 30 at 8 a.m.

Meantime, Basa was ordered to abide by the previously imposed special conditions of his release.

In 2006 Basa was sentenced to four years and six months’ imprisonment for conspiracy to distribute 50 grams of methamphetamine. He was placed on five years of probation after completing his prison term.

It was Probation Officer Gregory Arriola who filed the petition to revoke Basa’s supervision.

In his report submitted to the court, Arriola said Basa admitted on June 4 and 9 that he used methamphetamine again.

On June 4, Arriola said, he instructed Basa to report to his office for a random drug test. He said Basa failed to report at the designated time. An hour later, Basa called, admitting that he had “relapsed” and used “ice” the night before.

Arriola said Basa was instructed on June 9 to report to his office for another random drug test and that Basa eventually admitted that he used “ice” two days earlier and that he was having a hard time stopping from using it.

According to Arriola, with the shutdown of the Hinemlu O’hala Para Enteramenti Recovery or the HOPE Center due to the Covid-19 pandemic, Basa, who was among the occupants of the facility, went back home in March.

Basa had also been cited in the past for violating his probation, mainly for drug use.

At the revocation hearing, Basa was represented by attorney Bruce Berline while Assistant U.S. attorney Garth Backe appeared for the federal government.
